The Federal Guild of Vehicle Technology has updated its member service offering and incorporated a general “COVID-19” clause into its sample forms for the general terms and conditions/repair conditions.

The economy is in the stranglehold of the corona pandemic. In contrast to retail businesses, vehicle repair shops can at least stay open. But they also have to pay tribute to the crisis - and should at least add a paragraph to their legal protection through the General Terms and Conditions (GTC).
The Federal Guild of Automotive Technology and the Austrian Automotive Industry Association have revised the repair conditions for repair work on motor vehicles and for the preparation of cost estimates and updated them due to Corona. “A general clause “COVID-19” was incorporated into the existing repair conditions provided by the Federal Guild,” explains Andreas Westermeyer from the Federal Guild in the Austrian Economic Chamber (WKO).
The passage in question reads as follows: "The customer and we are aware of the current uncertainty due to the Corona pandemic (force majeure) and this has been taken into account in the basis of the transaction. The customer expressly declares that he agrees to the legal consequences of default in acceptance (in particular in accordance with point 18.)." Point 18 stipulates, among other things, that if the customer defaults on acceptance, the company providing the service is entitled to keep and store the vehicle if the contract is to be fulfilled, for which it is entitled to a storage fee that is displayed at the business premises. The terms and conditions also state: “This does not affect our right to demand payment for services provided and to withdraw from the contract after a reasonable grace period.”
With regard to effective legal protection through the general terms and conditions, members should, according to the professional representation, pay particular attention to the following:
- Die Muster-Reparaturbedingung der Bundesinnung stellt einen grundsätzlichen Standard dar. Eigenständige Änderungen sind möglich und Individualisierung der AGB (z.B. durch Ergänzungen und Ausfüllen betreffender Stellen) notwendig. Beides erfolgt jedoch ausschließlich auf eigene Gefahr.
- Die Reparaturbedingung sind mit dem Angebot mitzusenden.
- Im Angebot selbst hat der Satz, „Es gelten ausschließlich unsere beiliegenden Reparaturbedingung“, zu stehen. Erst, wenn das Angebot – mit dem genannten Hinweis – von Auftraggeber und Auftragnehmer unterfertigt ist, gelten die AGB.
- Bei der aufgenommenen Covid-19-Generalklausel handelt es sich um eine Absicherung, dass die betreffenden Reparaturbedingung-Bestimmungen (auch) unter den gegenwärtigen und (fortgesetzten) Covid-19 Maßnahmen gelten. Aus diesem Grund wurde auf die derzeit herrschende Ungewissheit auf Grund der Corona Pandemie (höhere Gewalt) Bezug genommen. Es wurde eigens darauf hingewiesen, dass diese Umstände den Vertragsteilen bewusst sind und sie in die Geschäftsgrundlage mit einbezogen wurden.
- Ausbreitung und Ansteckung mit Covid-19 sind bekannt und (daraus sich ergebende Folgen bzw. erhöhte Kosten) daher empfehlenswerter Weise in die Preise aktueller Kalkulationen einzurechnen.
