These days PSA has to appeal against the cartel court's ruling, otherwise the deadline will expire. PSA Austria spokesman Christoph Stummvoll never left any doubt that this would happen. According to lawyer Peter Thyri, who represents the Büchl company, there is then the possibility of an appeal for the applicant. The Supreme Court will then decide. In its statement in 2016, the Federal Competition Authority (BWB) had already identified numerous indications of competition violations on the part of manufacturers/importers. Car manufacturers would “abuse their dominant market position”. The BWB lists the following points: standards and investment specifications, guarantee and warranty remuneration, design of bonus systems, purchase obligations for operating equipment and, last but not least, the direct business of manufacturers/importers. According to a retail spokesman, the BWB's statement was essential for the verdict. Shirak now expects the manufacturers/importers to react and adapt the dealer contracts. In any case, it will be interesting to see which paths manufacturers will take from now on, says Schirak about the automotive industry. The trend – direct or agency sales – is clear.
